2026 Fee Schedule

USCIS implemented a fee restructure on April 1, 2024 that remains in effect for 2026. Many filing fees increased significantly. The Asylum Program Fee ($600) is now collected on most employment-based petitions. Always verify current fees on uscis.gov before filing.

Filing strategy: how forms relate

USCIS forms operate in sequences. Understanding which forms file together, which trigger others, and which are standalone saves applicants months and prevents costly errors.

The family-based green card sequence

For a U.S. citizen sponsoring a spouse who is already in the United States: I-130 + I-485 + I-864 + I-693 are filed concurrently, often with I-765 (work permit) and I-131 (travel document) added at no extra cost. After 2-year conditional green card issues, I-751 follows in the 90-day window before card expiration.

The EB-5 investor sequence

I-526E filed first to establish the investor petition. Once approved (and visa current), I-485 (if in U.S.) or DS-260 (if abroad) for the green card itself. Two years after admission as conditional resident, I-829 to remove conditions. After 5 years of LPR status, N-400 for naturalization.

The renewal cycle

Green cards must be renewed every 10 years using I-90. There's no fee waiver for renewals. Conditional 2-year cards do not get renewed via I-90 — they are converted to permanent 10-year cards via I-751 (marriage-based) or I-829 (EB-5).

Common cross-form mistakes

  • Filing I-90 instead of I-751 — Conditional residents accidentally file the renewal form. I-90 will be denied; meanwhile the I-751 deadline may pass.
  • Missing I-864 from joint sponsor — When primary sponsor doesn't meet 125% of poverty guidelines, joint sponsor's I-864 must accompany filing.
  • I-693 signed too early — Medical exam expires within 2 years of civil surgeon signature. If filing delays, you may need a second exam.
  • Concurrent filing eligibility missed — Many EB-2/EB-3 applicants file I-140 alone when concurrent I-485 was eligible, losing 6+ months of EAD/AP benefits.
