Form I-765 requests an Employment Authorization Document (EAD) — your work permit. Free if filed with Form I-485, $520 if filed standalone.
Filing fee: $520 (free with I-485) · Processing time: 3-12 months · USCIS link: uscis.gov/i-765
Who can apply for an EAD
Many categories of non-citizens can apply for an EAD. Common categories with their c-codes:
- (c)(8) — Asylum applicant (180+ days after I-589 filing)
- (c)(9) — Pending I-485 adjustment of status
- (c)(10) — Cancellation of removal applicant
- (c)(11) — Public interest parolee
- (a)(5) — Refugee
- (a)(10) — Asylum granted
- (c)(33) — DACA recipient
- (c)(3) — F-1 student post-completion OPT
- (c)(26) — H-4 spouse of H-1B with approved I-140
The eligibility category determines whether the EAD is automatically granted or discretionary, and validity period.

Auto-extension provisions
USCIS provides automatic extensions for certain EAD renewals. As of late 2024, the auto-extension period is up to 540 days for many categories — bridging the gap during EAD processing delays.
Auto-extension applies if:
- Renewal application filed before current EAD expires
- Same eligibility category as expiring EAD
- Eligibility category remains valid (e.g., I-485 still pending)
Form I-797C receipt notice + expired EAD = proof of continued work authorization during auto-extension period.
Required documents
- Form I-765 with fee (if applicable)
- Two passport-style photos
- Copy of government photo ID
- Copy of I-94 record
- Documentation of underlying eligibility (varies by category):
- Pending I-485 receipt notice (c)(9)
- Pending asylum receipt (c)(8)
- I-20 with OPT recommendation for F-1 OPT
- Spouse's H-1B approval and I-140 approval (c)(26)
- Previous EAD (front and back) for renewals
Combo card
Applicants who file both I-765 and I-131 (Advance Parole) with their I-485 receive a "combo card" — a single document that authorizes both employment AND international travel. This consolidation is the standard since 2014 for I-485 applicants.
