The wrong question is "which pathway is fastest?" The right question is "which pathway am I qualified for AND fastest to complete?" Many people qualify for multiple pathways simultaneously and should pursue the optimal one — sometimes in parallel.
Common qualifying combinations
- Indian tech worker on H-1B: Likely qualifies for EB-2 (employer-sponsored, 11+ year wait) AND potentially EB-1A or EB-2 NIW (self-petition, faster). Can pursue all three.
- Spouse of U.S. citizen abroad: I-130 immediate relative + consular processing OR K-3 spouse visa for faster entry. Not mutually exclusive.
- Wealthy entrepreneur: EB-5 Rural (12-24 months) vs E-2 (renewable but not GC) vs EB-1C (multinational executive, faster than EB-2/EB-3).
- PhD researcher: EB-1A (extraordinary ability), EB-1B (outstanding researcher), and EB-2 NIW often all qualify. File the strongest one first.

- Are you in the U.S. now? Determines AOS vs CP and whether you have current valid status.
- What's your education and work experience? Drives EB-1, EB-2, EB-3 eligibility.
- Do you have a U.S. citizen or LPR family member? Family pathway depends entirely on relationship.
- What's your timeline urgency? Pathways differ by 10+ years in waiting time.
- What capital can you deploy? Only relevant for EB-5.
